E. Health-related or sensitive information

Some responses, particularly information about pain, discomfort, injury, medical conditions, surgery, physical limitations, or ability to exercise, may constitute sensitive or health-related personal information. We do not request medical records, diagnoses, laboratory results, treatment histories, or detailed clinical information. Please do not submit detailed medical information through general forms or open-text fields.

Where required by law, we will request express consent before processing sensitive personal information. 8Yearsmore is not a medical provider, healthcare facility, physical-therapy service, emergency service, or diagnostic platform. Information submitted through forms is not continuously monitored and must not be used to request urgent medical assistance.

F. Communications, website, device, and email engagement

We do not use these processes to diagnose medical conditions or make medical treatment decisions.

D. Marketing, security, legal, and analytics

Depending on the context and applicable law, we process information based on consent, performance of a contract, steps requested before a contract, compliance with legal obligations, legitimate business interests where permitted, and protection of rights, safety, and security. Where express consent is required for sensitive or health-related information, we will request it separately or through an appropriate notice at collection.

6. Sensitive and health-related information

We may use health-related information to record a check-in, understand perceived program appropriateness, identify general safety concerns, improve instructions, provide non-medical reminders to modify or stop an activity, and encourage professional advice. We do not sell health-related information, use it for medical diagnosis, or use it for insurance, employment, credit, or healthcare eligibility decisions. Access should be limited to authorized personnel and service providers with a legitimate operational need.

7. Automated workflows and segmentation

Submitting a form may create or update a Shopify profile, add a tag, start an email sequence, add the customer to a segment, notify our team, record a check-in, or recommend a relevant next step. These processes assist program administration and marketing. They do not make legal, medical, employment, credit, insurance, or similarly significant decisions about individuals.

8. How we disclose personal information

We may disclose personal information to Shopify; providers of hosting, storage, email, marketing automation, analytics, payments, shipping, customer support, video meetings, community tools, security, accounting, and professional services; legal or regulatory authorities where required; parties involved in a merger, financing, acquisition, restructuring, or sale; and other parties at your direction or with your consent.

9. International transfers

Service providers may process or store information in Mexico, the United States, Canada, or other countries. Where required, we use appropriate contractual, organizational, and technical safeguards. Data-protection laws in another country may differ from those in your country of residence.

10. Cookies, marketing, and advertising

We and our providers may use cookies, pixels, SDKs, local storage, and similar technologies to operate the website, remember preferences, maintain sessions, secure transactions, measure traffic and email performance, and display relevant advertising where permitted. You may manage cookies through browser settings and available privacy-preference tools. We do not use check-in answers containing sensitive health details for interest-based advertising.

11. Testimonials, images, and recordings

Private check-in responses and feedback are not automatically public testimonials. We will request separate permission before publishing your name, image, voice, video, identifiable story, testimonial, or before-and-after information. Group meetings will not be recorded without notice and any consent required by law.

12. Retention and security

We retain information only as long as reasonably necessary to provide services, maintain accounts, meet legal and accounting obligations, resolve disputes, enforce agreements, prevent fraud, maintain program records, and document consent. Order and financial records may be retained for legally required periods; marketing preferences until withdrawal; program and check-in information for the program and a reasonable evaluation period; and sensitive check-in information only as long as needed for its stated purpose unless longer retention is required.

We use reasonable administrative, technical, and organizational measures, but no system is completely secure. Do not submit medical records, government identification, card numbers, passwords, or other highly sensitive information through open-text program fields.

13. Your privacy rights

Depending on applicable law and residence, you may have rights to access, correct, delete or cancel, object, restrict, withdraw consent, request information about transfers, request portability where applicable, and opt out of marketing. In Mexico, these may include Access, Rectification, Cancellation, and Opposition (ARCO) rights.

To submit a request, email contact@8yearsmore.com with the subject “Privacy Rights Request” and include your full name, account email, the right you wish to exercise, sufficient detail, and documentation reasonably necessary to verify identity. We may request additional information to protect the account.

14. Children, third-party services, and changes

Our programs are designed primarily for adults, including adults aged 40 and older. We do not knowingly collect children’s information without required parental or legal authorization. Third-party websites and services are governed by their own policies. We may update this Privacy Policy to reflect service, technology, legal, or business changes and will revise the “Last updated” date and provide additional notice where required.
